Services
Next Tier Digital provides digital marketing services for local service businesses, including but not limited to Google Ads management, local SEO, website design and development, and related consulting. The specific scope, deliverables, and pricing for any engagement will be outlined separately in a proposal, agreement, or invoice.
No Guaranteed Results
While we apply industry best practices, we do not guarantee specific rankings, ad performance, lead volume, or revenue outcomes. Digital marketing results depend on many factors outside our control, including platform algorithm changes, market conditions, and competitor activity.
Client Responsibilities
Clients are responsible for providing timely access to accounts, assets, and information needed to perform services, and for the accuracy of information provided to us.
Payment
Fees for services are outlined in the applicable proposal or agreement. Unless otherwise agreed in writing, services are billed on a recurring or milestone basis and are non-refundable once work has begun.
Communications & Calling
By providing your phone number, you consent to be contacted by Next Tier Digital by phone, text, or email regarding your inquiry, active services, or related business communications. You may opt out at any time.
Intellectual Property
Unless otherwise agreed, deliverables created for a client (such as website files or ad creative) become the property of the client upon full payment. Next Tier Digital retains the right to showcase completed work in its own portfolio and marketing materials unless the client requests otherwise in writing.
Limitation of Liability
Next Tier Digital is not liable for indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability for any claim is limited to the amount paid for the services in question over the preceding three months.
Termination
Either party may terminate an ongoing engagement in accordance with the terms outlined in the applicable service agreement. No long-term contracts are required unless otherwise stated.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
